Legal Strategies to Defend Against False Domestic Violence Claims

1. Gather Evidence to Refute Allegations

Collect communication records (texts, emails, call logs) showing no history of abuse.

Obtain CCTV footage or witness testimonies proving the absence of any violent incidents.

Medical reports (or lack thereof) can disprove injury claims.

2. Seek Custody Protection from the Family Court

File a petition under Guardians and Wards Act, 1890, to secure or restore custody rights.

Argue that false allegations are an attempt to alienate the child from the father, harming the child’s welfare.

3. Defamation & Perjury Cases

If false statements are made in court, file a perjury case under Section 191 & 193 of IPC.
